		<outline type="rss" title="The Right to Pornography" text="[Originally published in Turkish Daily News] A new hot debate started this week in the Turkish media with thedraft law prepared by Edibe Sözen, a member of Parliament on the ticketof the governing Justice and Development Party, or AKP. In order to“protect” the young from pornography and alcohol, Ms. Sözen’s proposalbrings some measures that raised eyebrows in the secular camp: Minorsbelow 18 will not be admitted alone in restaurants that serve alcoholafter 10 p.m.. Even if they are with their parents, they won’t beallowed to stay there after midnight. Pornographic material will besold in closed bags, and those who buy them will have to show their IDand give their citizenship number to the newsstand that sells them. Andthe newsstands will report these buyers to the local “youth and sportsdepartment.”Towards a shariah state?The whole idea seems to be about keeping porn and alcoholconsumption under control. And while I think it might not be a badidea, some of the elements in the draft, especially the one aboutmonitoring porn-consumers, are wrong.Let me explain. First, one should note that Turkey indeed needs somecheck on alcohol consumption by minors. In the United States, you can’tdrink if you are younger than 21. When you try to walk into bars, youwill often be asked to prove that you are old enough by showing your IDto the sizeable gentleman at the door. In Turkey, the situation is muchmore lax. A 15-year-old can easily walk into a bar and order the boozehe or she wants. So we will not become a “shariah state” or something,as the secularist media has started to chant yet again, if someregulation on alcohol consumption by minors is introduced. We will bejust more responsible.Pornography, no doubt, needs to be controlled as well. In the UnitedStates, which I see as the best example of a balance betweenindividuals liberties and moral concerns, not just pornography, buteven erotic scenes in normal movies are kept away from the eyes ofminors. And again, Turkey is much more lax. The motion picture ratingsystem used in American movies has no equivalence in this country.Here, a 10-year-old can freely walk into a movie theater and see, say,“Eyes Wide Shut,” which would be rated “R” in the country where itcomes from. There are even movie theaters in Turkey in which eroticfilms supplemented by porn scenes are played, and to which teenage boyscan freely go. Internet cafes, which are also listed in Ms. Sözen’sdraft as places that need regulation, are also often used by Turkishteenagers to access porn.But regulating obscenity is one thing, and monitoring the people whoindulge in it is another. And the latter, I believe, is dead wrong. Thestate has the duty to protect minors from pornography and similarvices, but when minors become adults they reach the level of beingresponsible for themselves and their decisions. If an adult wants toenjoy pornography, that is his (or her, but often his) decision. We canstill denounce that form of explicit sexuality as morally destructive,as most conservatives do, or condemn it as an act of exploitation ofwomen, as most feminists do. Then we have all the right to make apublic case against that industry by raising awareness through mediacampaigns or other civil means. Yet the state should not interfere withthe choices of consenting adults – unless it involves criminality suchas child porn.Therefore, I think, Ms. Sözen should give up her suggestion ofcollecting the names of citizens who buy pornographic material. In herspeech to the press, she said a similar law is in practice in Germany.I don’t know about the situation in Germany, but I know that a liberaldemocratic state does not have the right to monitor its citizens tocheck to see whether they buy magazines or films that present nakedbodies.Prayer At Schools?Another suggestion in Ms. Sözen’s draft is the opening of “prayerrooms” in public schools, “for students from all different religiousfaiths.” The secularist media perceived this as “an attempt to insertIslamic prayer to schools,” and Ms. Sözen responded by saying that shemeant “all faiths,” not just Islam.This is, again, a complex issue. It is nice that Ms. Sözen refers to“all faiths,” but it is also true that more than “99 percent” of Turkeyis Muslim, and the prayers rooms, if they will be opened, will all beIslamic ones. So, in real life, the issue is about allowing Islamicprayer in Turkish schools. And it is not easy to give an answer. On theone hand, there is the idea that public schools are supposed to besecular, so they should not promote religious services. But on theother hand, there is the idea that public schools, let alone privateones, should respect the demands of their students to observe theirreligious practices. Which one is true?The issue actually cuts down to this question: Should the secularstate respect the religious practices of its citizens and make someregulations accordingly? My answer is often yes, because otherwisereligious citizens would feel be discriminated against by the state.And they would be alienated.I recall that the director of my high school would not allowstudents to go to the Friday prayer by taking a slightly longer noonbreak. He used to say, “Study at school is more important than prayerat the mosque.” That sort of secularism is an assertive one that seeksto triumph over religion. And it is inevitable for true believers todislike, and stand against, such a secularism. The wiser way would beto develop a model in which the religious lifestyle would be embraced,as well as the secular lifestyle. And citizens should decide whetherthey are driven to prayer or porn. In readingthis, you will notice that I choose my words carefully. I do so becauseI, like many aboriginal people, have become accustomed to being toldthat aboriginals do not hold a patent on suffering. How manytimes have I been told that many people who are now citizens of Canadasuffered far worse indignities in their own countries before findingsanctuary on Canadian shores? And I am further reminded that manyimmigrants, both in the past and still today, have encounteredgovernment policy in this country that is overtly racist.However,government has evolved over time and the policies that once closed thedoors to many immigrants were radically altered by the introduction ofthe points system.Even so, I need not be reminded that even asthis apology was being drafted, the current government was beingaccused by opposition parties of nudging the door closed again with theintroduction of Bill C-50.That being said, many immigrants havecome from countries where any opposition to government policies wasruthlessly crushed. On arriving on Canadian soil they have found ademocracy that permits dissent and have exercised this freedom to bringabout change in government policy that reflects the demands of anever-changing demographic. The system is not perfect but it haswelcomed many people who would have faced an uncertain future in theirown homelands.During this same period, however, aboriginalpeoples were pushed to the margins of society by policies enacted toeliminate the Indian. The government attempted to strip away aboriginallanguages and cultures by establishing a residential school system thatwas, as Duncan Campbell Scott, deputy superintendent general of theDepartment of Indian Affairs from 1913 to 1932, stated, meant to drivea &quot;cultural wedge ... between younger and older Indians.&quot; This,combined with forced adoptions and the contradictory practice ofassimilation through isolation – also known as the reserve system –resulted in unfathomable damage to aboriginal families that is stillbeing felt today.Immigrant families who come to this countrycarry with them cultures, languages and spiritual practices that areopenly accepted and constitutionally protected. Their sense of identityis intact and they retain a sense of pride in who they are. Thisis not to say that aboriginal peoples have lost their identity. It has,however, been seriously eroded and the pride in who we are often hasbeen overshadowed by the shame of being relegated to the lowest levelof Canadian society.This is the legacy of Canadian policy toward aboriginal peoples. This long-overdue apology will serve three purposes:Itis the initial step the victims and their families need to begin thehealing process and to forgive the Canadian government and themselves.It places the responsibility for these crimes where it rightfully belongs: in the hands of the federal government of Canada.
